WAIVER AND RELEASE
IN CONSIDERATION OF ARTWORK SERVICES RENDERED from Christine Almstrom (the “artist”) at Riversong Studio (business), I agree to the following:
That I, ___________________ (clearly PRINT your name) have been fully informed of the service to be completed. I fully understand that once started the painting and artwork are permanent. Having been informed of the permanency of the service, I still wish to proceed with the agreed upon artwork and service(s) and I freely accept and expressly assume any and all risks that may come once initiated.
TO WAIVE AND RELEASE to the fullest extent permitted by law, the Artist and Riversong Studio from all liability whatsoever, for any and all claims or causes of action that I, my estate, heirs, executors or assigns may have for personal injury or otherwise, including any direct and/or consequential damages, which result or arise from the artwork and/or services rendered by the Artist or Riversong Studio.
That both the Artist and Riversong Studio have given me the full opportunity to ask any and all questions about my proposed and contracted artwork and service and all of my questions have been answered to my full satisfaction.
The Artist and Riversong Studio have given me instructions on the care of my artwork, and I understand them and will follow them. I acknowledge that it is possible that the piece of artwork and the material on which it is affixed can become faded or nicked over time particularly if I do not follow the instructions given to me. If any touch-up work to the piece is needed due to my negligence, I agree that the work will be done at my own expense.
Neither the Artist nor Riversong Studio is responsible for the meaning or spelling of the artwork (symbol, symbols, or text) that I have provided to them or chosen from the agreed upon piece (sketch, artwork, etc.).
Variation in color and design may exist between the art I have selected and the actual art when it is applied to the desired background material. I also understand that over time, the colors and the clarity of my piece may fade due to exposure to outside elements (sun, water, improper storage and/or handling, improper care and/or cleaning, mold/mildew, temperature extremes) and naturally occurring aging of the material.
The artwork applied is a permanent change to the background material ( i.e.: leather, etc.) and cannot be removed without disfiguring or damaging the surface and integrity of the material and which in all likelihood will not result in the restoration of the material to its exact appearance before being painted.
I release all rights to any photograph taken of my artwork and the piece and give consent in advance to their reproduction in print or electronic form.
I agree to reimburse the Artist/Riversong Studio for any attorney’s fees and costs incurred in any legal action I bring against either the Artist or Riversong Studio and in which either the Artist or Riversong Studio is the prevailing party. I agree that the courts of NEW HAMPSHIRE in SULLIVAN COUNTY shall have personal jurisdiction and venue over me and shall have exclusive jurisdiction for the purpose of litigating any dispute arising out of or related to this agreement.
I acknowledge that I have been given adequate opportunity to read and understand this document and I understand that I am signing a legal contract waiving certain rights to recover against the Artist and Riversong Studio.
If any provision, section, subsection, clause or phrase of this release is found to be unenforceable or invalid, that portion shall be severed from this contract. The remainder of this contract will then be construed as though the unenforceable portion had never been contained in this document.
